Conditions

1. Cancellation/Refund : In the event of the Clients cancelling the wedding for whatever reason the booking fee is non -refundable. It will be considered as liquidated damages to the Photographers.

Please be noted, that we do not provide refund. In case of Natural calamities or any emergency condition, if we are unable to provide full services, partial refund shall be provided, depending upon the situation.

2. Delivery Rules : Selected photograps for the album should be shared within 30 days of the event, otherwise Photographer will not be responsible for any data-loss or delayed delivery. Delivery day payment should be done upon receiving the Edited Video, if the Photographs are not selected by the client. If Photographs are selecte d before Delivering the video, said payment can be done after the Album Delivery.

3. Editing Rules :

i. Photographs – Along with this package, we shall be providing a certain number of edited soft copy of photographs as agreed during package confirmation, which can be shared anywhere or with anybody. UNEDITED PHOTOGRAPHS ARE STRICTLY UNSHARABLE. If you need anymore Edited softcopy of Photographs, you’ll be charged ₹50/- per Photograph additionally. Album Layouts can be edited maximum once. Even after confirmation from Client, if any further changes are to be made in the fi l e or t he album, charges will be applied accordingly.

ii. Video – We shall be providing a First Cut Video (Primarily edited) initially. Then after getting response, reviews and list of corrections to be made, we shall provide the Final Video on the day of Delivery. Video edit can be changed only once. More than one changes wil l be chargeable. Songs and music suggestions will taken beforehand.

4. Consultation Before Wedding: This normally happens at the time of booking. The Clients will outline broadly what is required and the Photographer will advise on planning, logistics and timings where needed. If required, the Clients are welcome to pop in for an addi t i onal c hat closer to the time of the wedding to iron out the remaining details. In any case, we will contact you by phone a few days before the we ddi ng t o ensure that there have been no last-minute changes.

5. Cooperation: The Clients and the Photographer consent to happily cooperating and communicating with each other to achieve the best possibl e result within the understanding of this contract. We recommend that the Photographer be provided with a helper (usually t he be st man) who will point out key individuals to be photographed. The Photographer may also require the assistance of the best man in organi sing family groups. The Clients also agree to give the Photographer sufficient warning of key events at the wedding to give the Photographer time to prepare. Please note that not all guests at weddings like having their photo taken. In such cases the Photographer will use his discretion bu t cannot be held responsible for a lack of photos of these people.

6. Paparazzi Wedding Guests: All your guests will have digital cameras and all your guests will want to photograph the Clients. In the spirit of cheerful cooperation, the Clients agree to give the Photographers precedenc e over the guests in order to take the photographs required for t he wedding services described above. We cannot be held liable for a lack of wedding photos if guests taking their own photos of the Clients continually interrupt the Photographer's work.

7. Venue Rules: Note the Photographers are sometimes limited by rules imposed by registrars, ministers and venue management as t o what c an and cannot be done. For example, some ministers insist that no extra lighting is allowed, and others will insist that the P hotographers shoot from a specific location. In such circumstances, the Clients agree to accept the technical limitations that may be imposed on the equipment use d. We advise the Clients to make themselves aware of the rules of the venue concerned and if necessary, negotiate with the personnel concerned.

8. Copyright Law: According the Copyright Act 1947, the copyright of photographs remains with the Photographer. The Photographer grants the Clients permission to make copies of the images under the following conditions.

      i. The images and video taken by the Photographer are for personal use by the Clients and their friends and relatives. Sale, Pub lication or any Commercial use of the photographs is not allowed without prior written permission from the Photographer.

       ii. All Raw photographs will be provided. So, Client will not use any Raw photographs anywhere at all. They can come up with a list of photographs they want to use or share, which can be in turn edited and provided to them and which can be used in personal or social network sharing purpose.

9. Model Release: The Clients grant the Photographer and its legal representatives, heirs and assigns, the irrevocable and unlimited consent to use the photographs of the Clients for editorial, competition, advertising and any other purpose and in any manner, to alter the photographs without restriction; and to copyright the images. The Clients hereby release the Photographer and its legal representatives, heirs an d assigns from all liability and claims in connection with the images.

 

10. Conveyance & Refreshment: Every event occuring outside of Kolkata, the travel expenses of photographers will be taken care by the clients. On the events dates, client will provide the meals for the photographers working in the project, otherwise providing the fooding expenses.

 

11. Data Protection: All the photographs & videos will be taken in Digital format and the fact is known to all the digital storages are volatile. Photographers will keep separate copies of the data. But in case of any hardware issue/damage/loss of data, no legal action can be taken against Photographers.

12. Privecy Policies : Any person signing up into the website, sharing contacts or booking the Photographer to provide services, are agreeing to all above Terms & Conditions and provide legal authorities. Also, their contacts can be used for promotional activities or references by the Photographers.

12. Payment Rules : Payment is scheduled in three instalments. Advance should be paid in full while doing the booking. Second instalment should be paid in full on the starting day of the events. Third instalment should be paid  oncethe Album Layout is confirmed and Album Print is processed or once the final video is delivered (whichever is done first). No exception is allowed
